Terms and conditions
Draft, October 2026
These terms apply when you buy something in the Texty shop. They're short on purpose; your statutory rights as a consumer always apply.
This page is also available in German; the German version is the legally binding one.
Entwurf / draft – [fill in]. This text was drafted by an AI assistant, not a lawyer. The owner must replace every [fill in] and have it checked before Texty is sold.
1. Scope and seller
- These terms apply to all orders placed in the online shop at texty.at between consumers and the seller: [fill in: full name], [fill in: street and number], [fill in: postcode and city], Austria, email [fill in] (“we”, details in the imprint).
- The contract language is German. Translations are for convenience; the German version is the binding one.
2. How the contract is made
- The products on our website are not a binding offer but an invitation to order.
- You choose products and quantities and the destination country in the cart on /shop, accept these terms and continue to the payment page of our payment provider Stripe. There you enter your email, delivery address and payment details and see the total price including shipping. You can correct your entries at any time before paying.
- By clicking the pay button you place a binding order. The contract is concluded when the payment has been completed successfully; we confirm this on the confirmation page, and Stripe emails you a payment receipt. With payment methods that take longer (such as SEPA Direct Debit), the contract is concluded when the payment arrives.
- We store your order. You can view your order at any time with the private link on the confirmation page; these terms are always available at texty.at/terms.
3. Prices
- All prices are in euros and are final prices. No VAT charged (small business exemption, Austrian VAT Act § 6(1)(27)).
- Shipping costs are added; they depend on the destination country and are shown in the cart and on the payment page before you order (see /shipping). There are no customs duties within the EU.
4. Payment
- Payments are processed by Stripe (Stripe Payments Europe, Ltd., Ireland). You can use the payment methods shown on the payment page, for example credit or debit card, Apple Pay or Google Pay. We never see your full card details.
- The purchase price is due when you order.
5. Delivery
- We deliver only within the European Union (all 27 member states) to the delivery address you give.
- Delivery time: we ship within [fill in: e.g. 3] business days after receiving your payment; transit times by country are on /shipping. If a product is not available after all, we tell you straight away and refund any payment without delay.
- The risk of accidental loss or damage passes to you when the goods are handed to you (or to a person you named who is not the carrier).
- The Texty contains a built-in rechargeable lithium-polymer (LiPo) battery. It is shipped inside the device in line with the rules for transporting lithium batteries; some carriers only transport such parcels by road, which can make delivery take longer.
6. Retention of title
- The goods remain our property until they have been paid for in full.
7. Right of withdrawal
- As a consumer you have a statutory right to withdraw from the contract within 14 days. How it works, and a model withdrawal form, are in the cancellation policy at /withdrawal.
8. Warranty
- The statutory warranty rights apply (Gewährleistung under the Austrian Consumer Warranty Act VGG and the Civil Code ABGB). The warranty period is two years from delivery.
- Please report defects to [fill in: email]. If a parcel arrives damaged, please tell us, and the carrier if possible – this helps us, but your rights don't depend on it.
- We give no additional guarantee beyond the statutory warranty unless we expressly say so.
9. Liability
- We are fully liable for damage caused intentionally or by gross negligence, and for personal injury. For slight negligence we are not liable, except for personal injury and to the extent mandatory law provides otherwise.
- Liability under the Austrian Product Liability Act (PHG) and your warranty rights remain unaffected.
10. Complaints and disputes
- If something isn't right, write to us at [fill in: email]; we will find a solution.
- The European Commission's online dispute resolution (ODR) platform was discontinued on 20 July 2025, so there is no link to it here. [fill in: check whether this is still current.]
- We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. [fill in: check, or name a body such as the Internet Ombudsstelle.]
11. Applicable law
- Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer living in another EU country, the mandatory consumer protection rules of that country still apply.
- For consumers, the place of jurisdiction is determined by the statutory provisions (§ 14 of the Austrian Consumer Protection Act, KSchG).
12. Privacy
- How we handle your data for orders is explained in the privacy policy at /privacy.
